And while pretty much any other news outlet could tell Governor Kay Ivey and bill sponsor Rep. David Standridge to get stuffed, <a href=\"https:\/\/www.wbhm.org\/local-news\/2026-09-29\/alabamas-gulf-of-america-act-free-speech-advocates-call-it-many-things-just-not-insignificant\" target=\"_blank\" rel=\"noreferrer noopener\">WBHM doesn\u2019t get that freedom<\/a> \u2014 as the station is licensed through the University of Alabama at Birmingham, which is a state institution, their staff members are all technically state employees.\u00a0<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>But wait,<\/em> you might be asking, <em>wouldn\u2019t that be a violation of their First Amendment rights?<\/em> You\u2019d sure think so, wouldn\u2019t you. <em>In general<\/em>, a state can\u2019t compel speech from its employees, <em>except<\/em> when it falls within the scope of their official duties, and reporting the news <em>is<\/em> certainly within the scope of WBHM reporters\u2019 official duties, <em>however<\/em> the First Amendment specifically forbids any law that would abridge the freedom of the press, so\u2026<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">No one\u2019s ever accused the Alabama government of having their shit anywhere close to together.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Shockingly, <a href=\"https:\/\/alison.legislature.state.al.us\/files\/pdf\/SearchableInstruments\/2026RS\/HB2-enr.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">the bill is extremely poorly written<\/a>, lacking any enforcement mechanism, leaving employees to wonder what the penalty for violation would be \u2014 <a href=\"https:\/\/www.al.com\/news\/2026\/09\/birmingham-public-radio-station-warns-forced-gulf-of-america-use-threatens-independence.html\" target=\"_blank\" rel=\"noreferrer noopener\">now-former WBHM GM Will Dahlberg speculated in his announcement<\/a> that penalties could potentially include termination. And it doesn\u2019t specify that the law refers only to references made in a professional context, not guaranteeing employees wouldn\u2019t also be penalized for personal speech. And if you\u2019re back to, <em>No, seriously, that has to be a First Amendment violation<\/em>, like, we\u2019ve been over this.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Standridge said during hearings on the bill earlier this year, \u201cI think this is an opportunity to make a patriotic statement. I think the president would embrace it.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The job of the (ostensibly) free press is not to make patriotic statements. And it\u2019s not to make the President of the United States happy \u2014 the press is supposed to be questioning and even adversarial, because their responsibiltiy is to the people who rely on it to know what\u2019s going on in our government. And the job of our elected legislators is not to make the President happy \u2014 the Constitution actually places Congress as a check to the president\u2019s power, in a sometimes-adversarial position to make sure laws are made to uphold the best interest of the people and not the whim of the Executive.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But in the year of Dolly Parton two thousand and twenty-six, we don\u2019t get to have an adversarial legislature, and WBHM can be forced to say \u201cGulf of America\u201d to be patriotic and please the president. I guess that\u2019s just how it works now.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Okay, the fait is not <em>quite<\/em> as accompli as all that \u2014 press advocacy groups are pointing out that, in fact, yes, the First Amendment doesn\u2019t allow the state to dictate the content of the media, even if it owns the platform, all of which will be addressed\u2026 whenver someone has the opportunity to file a legal challenge, at some point, until which \u201cGulf of America\u201d \u2014 or, more likely, just \u201cGulf,\u201d straight-up \u2014 is it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">So if you\u2019re listening to WBHM today, or in the near future, and it sounds a little bit stupider, cut the reporter some slack. It\u2019s not their fault.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Our world has just gotten that much stupider.
