This isn\u2019t about the \u201cJohnny Depp brand advantage,\u201d which are words someone typed and then read and then said <em>Yeah, that\u2019s fine<\/em> and then clicked Publish.<\/p>\n\n\n\n<p>This isn\u2019t about the \u201cDepp-Heard show,\u201d which is not in fact a show but actually a defamation case surrounding allegations of domestic violence, where words like \u201cI\u2019ve never been so scared in my life\u201d have been spoken on the stand.<\/p>\n\n\n\n<p>This isn\u2019t about \u201cDepp-Heard\u201d becoming \u201cits own content economy,\u201d which has taken place largely in the form of mocking memes constructed on a woman\u2019s testimony about her alleged abuse at the hands of her husband, and which, yeah, was lampooned on SNL, which was also pretty atrocious.<\/p>\n\n\n\n<p>This isn\u2019t a \u201cdark ride\u201d with \u201coften jaw-dropping twists and turns.\u201d<\/p>\n\n\n\n<p>It\u2019s not a \u201creferendum on celebrity popularity.\u201d<\/p>\n\n\n\n<p>It\u2019s a defamation case surrounding allegations of domestic violence.<\/p>\n\n\n\n<p>It\u2019s a case that started with an article titled, \u201cI spoke up against sexual violence \u2014 and faced our culture\u2019s wrath,\u201d and has included testimony from two people detailing abuses allegedly committed against them, some of which has already been bastardized for the TikTok lulz but hey, what the hell, there\u2019s more juice to squeeze out of this lemon, right, Ad Age?<\/p>\n\n\n\n<p>What the actual hell?<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What it is about<\/h2>\n\n\n\n<p>While we\u2019re talking about things I wouldn\u2019t have seen myself having to do: I wouldn\u2019t have seen myself having to explain why things like domestic violence aren\u2019t fodder for har-de-har Spicy Celeb clickbait, but again, we live in a time of surprises, so here I go.<\/p>\n\n\n\n<p>It\u2019s about an observation of how our culture treats survivors of domestic violence (which I think we can all agree, judging from public reaction to this very trial, is \u201cbadly\u201d), and the callousness with which society treats serious cases that affect actual human people.<\/p>\n\n\n\n<p>It\u2019s about the public\u2019s perception of male victims of domestic violence (regardless of your feelings about whether or not Depp himself is one of those).<\/p>\n\n\n\n<p>It\u2019s about the implications of violence from multiple parties, and how (and if) we assign fault and victimhood.<\/p>\n\n\n\n<p>It\u2019s about parasocial relationships, and the way celebrity worship can drive people to do some pretty heinous stuff.<\/p>\n\n\n\n<p>And it\u2019s about the message all of this is sending to actual survivors of domestic violence, of all genders, who have probably seen (whether they wanted to or not) testimony and evidence that matches up with their own experiences, causing them to relive some of the most terrible times in their lives, and then seeing it all reduced to a joke, to TikTok videos and SNL gags and armchair legal and mental health experts declaring people to be liars and narcissists with agendas.<\/p>\n\n\n\n<p>And if you\u2019re seeing the whole thing as a matter of ratings, clicks, views, follows, and comedy fodder, you need to question where your perspective got so severely distorted.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">I\u2019m sorry, <em>what<\/em>?<\/h2>\n\n\n\n<p>In case you don\u2019t feel like perusing \u201cDepp-Heard: 6 Lessons From \u2018Hollywood\u2019s Trial of the Century,\u2019\u201d here\u2019s what you\u2019re missing:<\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"alignleft size-full is-resized\"><img loading=\"lazy\" decoding=\"async\" width=\"800\" height=\"600\" src=\"https:\/\/capertongillett.com\/blog\/wp-content\/uploads\/2022\/06\/depp-heard-trial.jpg\" alt=\"A photo of Amber Heard on the stand during the trial. She\u2019s wearing a gray suit and a brown blouse, and she appears to near tears.\" class=\"wp-image-3023\" style=\"width:400px;height:300px\" srcset=\"https:\/\/capertongillett.com\/blog\/wp-content\/uploads\/2022\/06\/depp-heard-trial.jpg 800w, https:\/\/capertongillett.com\/blog\/wp-content\/uploads\/2022\/06\/depp-heard-trial-300x225.jpg 300w, https:\/\/capertongillett.com\/blog\/wp-content\/uploads\/2022\/06\/depp-heard-trial-768x576.jpg 768w, https:\/\/capertongillett.com\/blog\/wp-content\/uploads\/2022\/06\/depp-heard-trial-320x240.jpg 320w\" sizes=\"auto, (max-width: 800px) 100vw, 800px\" \/><figcaption class=\"wp-element-caption\">5 Tips for Mocking an Alleged Victim of Domestic Violence on TikTok <em>(Michael Reynolds\/Pool\/AFP)<\/em><\/figcaption><\/figure>\n<\/div>\n\n\n<p>Citing Depp\u2019s \u201cbrand advantage\u201d \u2014 the fact that he has a long career including films beloved to Gen Xers and a Disney franchise where he played a quirky, funny, likable character \u2014 contrasted with Heard\u2019s more modest career, turning the trial into a \u201creferendum on celebrity popularity\u201d instead of a <em>court trial concerning domestic violence<\/em>, as a justification for some people considering him a more credible witness even though it has fuck-all to do with his actual abusive behavior or lack thereof.<\/p>\n\n\n\n<p>Bringing #MeToo into it, because it\u2019s not enough to trivialize just <em>one<\/em> domestic violence case, we have to drag the concept of \u201cbelieving women\u201d into the mix to pit recordings of two \u201cprofessional fakers\u201d against each other, one (and only one) of whom must be \u201cjust performing.\u201d<\/p>\n\n\n\n<p>Pitting the #justiceforamberheard and #justiceforjohnnydepp TikTok hashtags against each other and declaring a winner, as if both aren\u2019t being used to mock, demean, discredit and flat-out condemn a woman (almost exclusively) for her testimony about abuse allegedly visited upon her.<\/p>\n\n\n\n<p>Reducing the entire trial, allegations, conflict, anguish, to a \u201ckiller app\u201d and a ratings boom for a couple of cable networks and their YouTube channels as viewers flock to their content to consume the trial like it\u2019s a soap opera.<\/p>\n\n\n\n<p>Characterizing the whole thing as \u201centertaining. Yes, in the way that a train wreck is entertaining \u2014 but entertaining still the same.\u201d<\/p>\n\n\n\n<p>I will acknowledge that the article is correct in observing that, in today\u2019s media culture, \u201ccelebrity dysfunction beats celebrity worship.\u201d I\u2019ll then ding it for the lack of self-awareness required to see that this article is not fucking helping.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What the hell is this?<\/h2>\n\n\n\n<p>I\u2019m going to have to bring in one more thing that I\u2019d rather not, but again, I\u2019m doing a lot of things I\u2019d rather not in this post: the question of bias on the part of the article\u2019s author, Simon Dumenco. I\u2019m not going to come straight out and accuse him of taking one side or the other, because I can\u2019t know what\u2019s in his head. But the dismissive comments about her career, the boos she\u2019s received outside of the courtroom, his just-asking-questions comments about her potentially \u201cjust performing,\u201d the unnecessary parenthetical about whether or not she might have actually been faking her injuries (all safely attributed to other people so <em>he<\/em> couldn\u2019t be accused of bias, he\u2019s just reporting the facts) without any mitigating perspective from another side of it \u2014 it leads one to wonder about whether Dumenco has an agenda that he\u2019s clumsily tried to disguise as impartial educational content. (See? I didn&#8217;t say <em>I<\/em> wondered, just that one <em>might<\/em> wonder, and that completely obviates any responsibility on my part.)<\/p>\n\n\n\n<p>And I have to ask: What the hell is this doing on an advertising industry website? What does this have to do with advertising? Why would Ad Age be an appropriate venue for a thinly veiled assessment of an ongoing court case surrounding a domestic violence dispute? Who read this and thought, \u201cYes, everything about this is legit and has a place on our site\u201d?<\/p>\n\n\n\n<p>Ad Age, the best time for a public apology would have been about ten seconds before you clicked Publish on this godawful article. Like, the appropriate content for this particular slice of internet would have been <em>Y\u2019all, this might not make sense, but we\u2019re extremely sorry for almost posting the thing we just reconsidered and decided not to post. XOXO, Ad Age.<\/em> But failing that, time travel not being a thing, the second-best time is now. And if you\u2019re lucky, this extremely painful, vulnerable moment in your life won\u2019t be mocked incessantly and repurposed for content.
